The new regulation on the deductibility of losses from worthless assets has been in effect since January 1, 2020 (Section 20 Paragraph 6, Sentence 6 EStG). Accordingly, losses from worthless expiration, worthless derecognition or worthless transfer of certificates and warrants can only be offset against income from capital assets up to a maximum of 20,000 EUR per calendar year.
According to a letter from the Federal Ministry of Finance, the bank has no longer been allowed to offset losses in this case since the beginning of 2021. Therefore, as of January 1, 2021, losses from certificates and warrants that expire worthless are no longer taken into account in the general loss offset pot.
For you, this means that losses from the worthless expiry, the worthless derecognition and the worthless transfer of certificates and warrants will no longer be taken into account by us. In the future, you can offset your losses on your tax return.
